Construction and Development Advisory Services Practice

Unlike many construction advisory groups, our practice is the outgrowth of a transactional real estate practice rather than a claims based practice. Approximately 85% to 90% of our construction and development practice (both legal and consulting) involves the representation of owners. Our approach focuses on understanding the unique goals, challenges and requirements of each specific project and client in order to develop a holistic and cohesive approach — accordingly, our approach begins with listening. We start every project by carefully reviewing the available information, asking questions and listening to the client so we can better understand its needs and goals. Then, we analyze the information to develop a business case that sets forth how the project can best be delivered in light of the unique goals, challenges and requirements of the client as well as the project, and in doing do so, focus on the business relationships between the parties, and the goals and interests of each of those parties (owner, contractor, architect and end-user).

Through this approach, we focus on structuring procurements, contracts, and projects in a way that aligns the interests of the parties in order to maximize the chance that projects are delivered on-time, on-budget and in a manner that meets the needs (both aesthetic and operational) of our clients. In this way, we take a proactive approach to the alignment of the parties’ desires and view litigation as a failure in and of itself — even if our client ultimately prevails.

As real estate development professionals, we understand that construction is about more than bricks and mortar. Often the most challenging aspects of projects are not the brick and mortar, but rather the practical realities of the environments in which the project must be implemented. This is particularly true when building on an occupied facility — where issues related to swing space, coordination with end users and ongoing operations and security are likely to be paramount. Whether it is the needs of end users (both during construction and after substantial completion), the requirements of regulatory authorities, or other unique requirements of projects, we strive to develop holistic and cohesive approaches to projects — not just buildings. Renewable Energy Practice

As an outgrowth of our construction and development practice, Leftwich has assisted the District of Columbia in several of its progressive and novel renewable energy transactions. Relying on experience gained representing the Washington Convention Center Authority in connection with a public-private-partnership for the financing and construction of the central plant for the Walter E. Washington Convention Center, the firm represented the District’s Department of General Services in its innovative renewable energy efforts.

Under a Power Purchase Agreement (PPA) negotiated by Leftwich, Iberdrola Renewables, LLC will supply 35 percent of the District government’s electricity with wind power. At the time, this PPA was the largest wind power deal entered into by an American city and projected to save District taxpayers $45 million over 20 years. For this innovative PPA, the C40 Cities Climate Leadership Group awarded the District of Columbia its global award for Green Energy at 2015’s 21st Conference of the Parties and Climate Summit for Local Leaders.

Leftwich also represented the District’s Department of General Services in connection with PPAs to install solar facilities on District facilities. This PPA with Nextility Inc. increased the District’s total solar generation capacity by roughly 70 percent through the deployment of 11.4 megawatts of solar photovoltaic systems on the roofs and parking lots of 34 District-owned facilities.
